TERMS & CONDITIONS OF PURCHASE

TERMS & CONDITIONS OF PURCHASE

By using the RauFurniture.com ("Rau") web site ("Web site"), and/or by purchasing products by Internet, phone, electronic, verbal, written or other form of order confirmation, you the customer ("Customer") agrees to become bound by the terms and conditions of this agreement ("Agreement"), and this Agreement shall govern and control your use of this Web site and any and all current or future orders and/or purchases ("Order") you may make by Internet, or phone, through or because of this Web site. If these terms and conditions are considered an offer by RauFurniture.com ("Rau"), acceptance is expressly conditioned upon your assent to all of the terms and conditions of this Agreement without modification, to the exclusion of all other terms. In order for Rau to sell furniture at these low prices. The Customer hereby accepts and agrees to be bound by the flowing terms:

  • Accuracy.
    While Rau uses reasonable efforts to include accurate and up-to-date information n its Web site, Rau makes no warranties or representations as to the accuracy of the information. Rau assumes no liability or responsibility for any errors or omissions in the content of the Web site. In the event a product is quoted by a Rau associate at an incorrect price, or due to a typographical error in pricing, Rau shall have the right to refuse or cancel any Order placed by the Web site or phone. Rau shall have the right to refuse or cancel any such Order whether or not the Order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your Order is subsequently cancelled by us, Rau shall issue a credit to your credit card in the full amount of your payment.
  • Products
    All products are subject to availability. Due to the character of various products, all dimensions are approximate. Actual leather and fabric sample colors may not match your monitor. Actual wood stain colors may not match your monitor. Products, information, availability, prices, and/or specifications are subject to change without notice. All prices are in U.S. Dollars.
  • Order Acceptance
    Upon your placement of your credit card information into our Web site and processing payment by your credit card, verbal authorization for us to charge your credit card, check by phone, or other forms of payment to our bank account or associates by check or cash constitutes the immediate acceptance of this Order by the Customer, and Customer hereinafter agrees to be bound by all terms and conditions of this Agreement, and the Order cannot be canceled by the Customer. Rau reserves the right at any time to accept or decline your Order due to inaccurate pricing, non-availability of products from the manufacture or distributor, or for any other reason. Rau reserves the right to verify and any information you provide prior to accepting an Order. A credit card, check or other form of payment for the Customer's deposit and subsequent payment in full for their Order cannot be stopped or credited back to the Customer without the written consent of Rau.
  • Pick Up of Furniture
    All pricing is based upon the Customer picking up their furniture at a Third Party Warehouse in Frankenmuth that will be receiving your furniture for safe keeping. You agree to pick up your furniture within 5 days after being notified of the arrival of your new furniture. Customer is to look at all boxes and cartons to see if there is any unusual damage to any boxes before picking up. If for some reason furniture is damaged prior to picking up, Rau's will either re-order replacement furniture or correct it if agreeable to Customer. Customer is to provide their own straps to secure your furniture, along with blankets and any other packing materials to protect your furniture when picking up their furniture. Customer takes on all responsibility to load their own vehicle as Rau, or Third Party Warehouse, does not take on any liability of the furniture once it is picked up by Customer or anyone who Customer may hire or have retained to help Customer. It is also agreed if Customer does not pick up their furniture within the 5-day period there will be a $5 charge per piece for each day it is not picked up and the Customer's Furniture will not be release till the late pick up fee is paid.
  • Delivery of Furniture
    Delivery is available but not by Rau. If Customer desires delivery Rau has an outside delivery service available for Customer's dealing directly with this third party. Customer is to make own arrangements with this or any delivery service of their choice. Again, Customer is to work with their delivery service and have the furniture picked up by the delivery service within an 8-day period or there will be a $5 charge per piece for each day it is not picked up and the customer's Furniture will not be released till the late pick up fee is paid. Any exceptions to this must be approved by Rau. Please be aware that delivery companies regularly will leave the cardboard and packaging materials at your home in an area you designate.
  • Manufactures Warranties
    There are manufacture warranties on most furniture and mattresses. Rau DOES NOT warrant the furniture. It is the manufacture that warrants the furniture, and with our low prices it will be Customer's responsibility to work with the manufacture if there are any warranty issues. All products purchased through Rau are sold as New Furniture, and "AS IS" with NO returns. NO cancellations, NO refunds. If there is any hardware or parts missing let Rau know within 3 days and Rau will work with Customer to make sure that product you receive is in the way it was represented in the Web site pictures, and descriptions. Once Customer picks up their furniture, or has their delivery company pick it up, or have another party pick it up for Customer, the Customer is fully responsible for this furniture. Rau will not accept any liability or damage of Customer's furniture once it is picked up by Customer or Customer's representatives.
  • 5 Year Protection Warranty Plan
    Rau highly recommend Customer to purchase ULTRA SHIELD 5 Year Protection Warranty Plan from Rau to protect Customer's new furniture. This must be purchased at time of purchasing the furniture and cannot be purchased once the furniture has been received by the Customer.
  • Length of time to receive New Furniture
    Most of Rau Furniture you see on this Web site is warehoused and ready for delivery within 2 weeks. Some of the items are in manufactures warehouses and others will be custom built for you and some will have a longer delivery than preferred. Rau will take every possible remedy to get your furniture to you as quickly as possible, however Rau cannot guarantee any definite time of shipment. Rau will do their best to keep Customer informed of any delays and estimated shipping times. Rau cannot be held responsible for any delays in delivery of your furniture for any reason. Shipping times will vary per manufacturer and Distributor. Allow a minimum of 2 to 8 weeks for delivery, depending upon the availability from the manufacturer. We work hard to make your shopping experience a pleasant one, and we want you to enjoy your new furniture for many years to come. We also want you to tell all your friends about us!
  • Sales Tax
    Michigan sales tax will be added to all items shipped into the State of Michigan. Sales tax will not be collected for Orders shipped into other States. Customers must take responsibility for complying with the applicable laws in the State they live in regarding the payment of any sales and/or use tax on goods ordered for delivery to any State other than Michigan.
  • Payment
    100% payment of invoice is required at time of purchase. Your Order will not be processed until we receive your full payment. If payment by check your order will not be processed until the check clears into Rau's bank.
  • Customer Responsibilities
    On Furniture that is not on our Web Site it is the Customer's responsibility to provide Rau with all accurate model numbers, finishes and fabrics for their respective Order. It is the Customer's responsibility to check their Order receipt for complete accuracy within one day after they receive it by e-mail, fax, mail or UPS, whichever shall first occur. Customer must notify Rau immediately if any model numbers or items are not correct. If Rau does not hear from Customer within this one day time period, all items will be shipped as ordered and cannot be changed, exchanged or canceled. Rau is not responsible for any inaccurate items or model numbers ordered by the Customer. The Customer acknowledges that they have seen or inspected the type, manufacture, quality or manufacturer, and style of furniture they are purchasing from Rau at local stores or elsewhere. Rau does not guarantee or warranty the type, quality, color or style of the furniture the Customer chooses. Rau is not aware of the accuracy and level of the Customer's floors in their home, so consequently it is the Customer's responsibilities to level all products from their Order once they receive them, including cabinets, dressers, armoires, wall units, etc. that may create uneven doors or other items that may be out of align due to improper leveling. Rau's is not aware of the size of Customer's home or doorways; consequently, it is the Customer's responsibility to make sure items will fit in their home at time of purchase. The Customer is responsible to note the size and dimensions of the furniture to insure that it will fit, not only in the designated room, but also will go through hallways, air locks, doorways, stairwells, etc.
